Public Consultation on Market Definition and Dominance (MDD) Report 2020

Introduction

In accordance with the functions vested in the Telecommunications Regulatory Authority (TRA) of Oman, the TRA is undertaking a periodical review of the telecommunications service markets, with the view of updating the Market Definition and Dominance Report published in 2013.

Since the issuance of MDD Report 2013, many significant developments took place in the sector such as entry of OBC, Awasr Oman, OTC and the forthcoming third mobile operator. Similarly, the market witnessed growth in the deployment of fiber, LTE and fixed 5G services whereas 5G mobile services are also in the pipeline. From consumers’ side, demand for data services, bundled plans and OTT services are on the rise. The MDD Report takes into consideration all such developments, both at retail and wholesale level, and reviews the definition of markets, the list of relevant markets and the ex-ante obligations that dominant service providers in those relevant markets are subject to.
The TRA has completed its preliminary assessment which is set out in the draft MDD Report 2020. The TRA is pleased to invite licensees, stakeholders, interested parties and the public in general to respond to this consultation by providing their comments and views on the contents on the consultation document.
The public consultation process is as follows.

Submission Date

  • Phase 1:
  • Public telecommunications licensees and other stakeholders and members of the public may make submissions in writing in relation to the questions set out in the Consultation. These should reach the TRA no later than the 3.00 PM on 20th September 2020. All submissions will be published on the TRA’s website following the receipt.

  • Phase 2:
  • Those parties that made submissions during Phase 1 will be given a limited period of 10 working days to make any further comments and provide further evidence in relation to matters or arguments raised by other submissions. Please note that Phase 2 is intended to provide a limited opportunity to comment on or correct other submissions, and will only be open to those who made submissions in Phase 1.
    Following the completion of both Phases, the TRA shall consider all the comments received and then publish a final MDD Report.

Any comments provided in response to this Public Consultation Document should be provided in hard or soft copy (both in PDF and Word format) to the following addresses:

The TRA welcomes all comments on the Consultation. The TRA encourages respondents to support all comments with relevant argument and if relevant, data, analysis, benchmarking studies and information based on the national situation or on the experience of other countries and indeed, may give greater weight to comments supported by such evidence. In providing comments, respondents should indicate the question number to which their comments relate. The TRA has prepared specific questions for respondents to address if they wish. It would be helpful to the TRA if respondents answered those specific questions of interest to them, but submissions may take any form that the respondent chooses. The TRA is under no obligation to adopt the comments of any respondent.
In case any respondent wishes to keep any part of their response as confidential, they should indicate that clearly and provide a redacted version for publication. In absence of a redacted version, no submission, or part thereof, will be considered as confidential.

Phase 2 of the Public Consultation on the Draft MDD Report 2020 – Comments on Comments:

This has reference to TRA’s public consultation document on the draft Market Definition and Dominance (MDD) Report 2020, issued on 28th July 2020 inviting comments on the draft MDD Report. Under Phase 1 of the public consultation, the TRA has received responses and comments from telecom licensees and other stakeholders, in relation to the draft MDD Report and the questions set out in the consultation document. All these submissions have been placed on TRA’s website. In Phase 2, the parties who made submission in Phase 1 of the public consultation are now invited to make comments on other parties’ submissions along with supporting evidences.
The deadline for Phase 2 submissions is 9th December 2020. Please note that the TRA will be under no obligation to consider comments received after the above mentioned deadline. Following the completion of Phase 2, the TRA shall consider all comments and issue its Positional Statement and decision on final MDD Report.
